MANUCURIST PRIVACY POLICY

This website ("Site") is owned and operated by Manucurist Inc. ("Manucurist"). Manucurist takes your privacy seriously. This Privacy Policy describes what information this Site gathers about you, how we use that information, and what steps we take to protect that information.

By using this Site, you consent to the terms of this Privacy Policy Manucurist may change this Privacy Policy from time to time. Please check back periodically for up-to-date information about our privacy practices.

1. INFORMATION COLLECTION

This Site collects information about you to provide and improve our services, communicate offers that we believe will interest you, and to administer our business.

Information You Provide to Us:

We collect personal information from you when you submit that information to us voluntarily. For example, we collect information from you when you:

  • place an order on the Site;
  • create an account on the Site;
  • communicate with our customer service team online;
  • participate in an Manucurist promotion, such as a sweepstakes or contest;
  • post a tagged photo or other content on a third-party social network; or
  • post a product review, question, answer, or other information on the Site.

The personal information we collect may include the following: email address, mailing/billing address, phone number, payment card number, other payment information, and gender. Manucurist does not sell this personal information as the term “sell” is traditionally understood. However, to the extent “sale” is interpreted to include advertising technology activities such as analytics section as a “sale,” we will comply with applicable law as to such activity. Collecting this information allows us to complete your order efficiently, to notify you of your order status, and provide personalized interactions. We may further use and partner with different types of entities to assist with our daily operations and manage our services or improve the quality or personalization of our communications to you, and help prevent or detect fraud. If you are under 18 years of age, please do not submit any Personal Information to us. If you are the parent or guardian of a person under 18 years of age who has provided Personal Information to us, please contact us by clicking here.

But for gender, we do not collect legally protected demographics information such as your race or ethnicity identity.

Any demographic data we collect is subject to the same terms herein namely Section 2 below.

When you use these features on our Site, you represent to us that you are entitled to use and give us your friend's name and contact information, including email address.

Non-Personal Information and Automated Information Collection

In addition, we may also receive, store, collect non-personally identifiable information, such as IP addresses (which identify your device), pages viewed, computer type, screen resolution, operating system version, Internet browser type and version, information collected through cookies, pixel tags, web beacons, and other technologies, and other data (“Non-Personal Information”). This information helps us to make our Site work more efficiently, evaluate use of our Site, and support our website analytics and marketing campaigns. Because Non-Personal Information does not personally identify you, we may collect, use and disclose Non-Personal Information for any purpose. Non-Personal Information will be retained only for so long as to fulfill a legitimate business need.

Information from Third Party Sources

We may collect information about you from third parties or for analytics purposes. Such information may include demographic data (like the number of members of your household, age, and gender) and purchase preference information. We may use this information to supplement or update our records, improve the quality or personalization of our communications to you, and help prevent or detect fraud.

Website

When you access or use our Site (defined above), we may receive information about the device you are using. This information may include, but is not limited to, the type of device you use, the temporary or persistent unique device identifier (UDID) placed by us or our service providers, the unique identifier assigned by Manucurist to your device, the IP address of your device, your operating system, the type of browser you use, and data from the way you use our Site.

Our Site may also collect information about the location of your device. For example, the IP address of your device may reveal information about your approximate location. Your device should require you to provide permission before our Site obtains precise geolocation information from a browser's geolocation API or from technologies like GPS, Wi-Fi, and/or cell towers. We and our service providers may use this approximate location and/or precise geolocation information, along with other information submitted by you, to provide you with location-based services like local store information, search results, special offers, and other personalized content.

Most browsers and mobile devices allow users to enable or disable precise geolocation using pop-ups or controls located in the settings menu. If you have questions about how to disable your device's precise geolocation services, please contact your browser developer, mobile service carrier, or device manufacturer. You may also stop collection of precise geolocation information by our mobile application by uninstalling the mobile application using the standard uninstall process available as part of your mobile device.

2. INFORMATION USE, DISCLOSURE, AND SHARING

Personal Information to Provide Services: We use Personal Information to process and fulfill any orders that you have placed, contact you about our products and services, personalize your experience with us including by presenting products or offers tailored to you, and allow you to use, communicate and interact with others on our Site. This may include sharing information with third parties that provide us with services such as Site hosting, data analysis, payment processing, order fulfillment, infrastructure provision, information technology services, customer service, e-mail delivery services, credit card processing, auditing, training, and other similar services. These third parties may have access to Personal Information necessary to perform their functions but may not use it for other purposes.

Site and Marketing: We may use aggregate information to improve and enhance your experience on the Site and for our market research activities. For example, we may share aggregate information with unaffiliated third parties, such as business partners, site analytics vendors, manufacturers, distributors and retailers, in an aggregate, anonymous form (“Aggregate Information”), which means that the shared information will not contain nor be linked to any Personal Information. We may also share your Personal Information with third party service providers in order to improve our marketing and advertising activities.

Some browsers have a 'do not track' feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so our Site is not currently designed to respond to those signals.

As Necessary: We may disclose Personal Information as we believe necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. Additionally, if we, or substantially all of our assets, were acquired by a third party, or if we go out of business or enter bankruptcy, user information will be considered an asset of ours and may be transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of user information may use your information per this Privacy Policy.

Mailing List: In order to maintain our mailing list, we may combine information you give us online with information that is publicly available and/or provided by our third-party service providers or another company. We may also share your information with or lease information from other companies offering products or services that may be of interest to you. If you received our marketing materials and don’t know why, we may have received your information from another company. If you do not want to receive mailings or other marketing materials from us or if you do not want us to share your Personal Information with other companies, please contact us by clicking here.

Distributors and Other Offers: We may at times share our customers’ email addresses with distributors, manufacturers and/or other service providers that we believe will be of interest to the Manucurist audience. From time to time, we may give you the opportunity to opt in to participate in special third party offers that require us to share certain Personal Information with such third parties. We will disclose this anticipated sharing of Personal Information at the time we make such opportunities available to you. If you opt in to participate in such an offer, we may disclose your Personal Information to such third parties for their direct marketing purposes. We recommend that you consult such third parties' privacy policies in advance if you wish to participate in these offers.

Mobile Terms of Service: The Manucurist mobile message service (the "Service") is operated by Manucurist .
Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Manucurist’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Manucurist through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Manucurist. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Manucurist or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Manucurist mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

3. SECURING YOUR INFORMATION

Manucurist does not store any credit card information which is processed by third party providers. However, it works to protect other personal information we may collect. 

To ensure the security of your personal information, you should always provide that information over a secure connection. You can check the existence of a secure connection in one of two ways:

(1) Look at the URL in your web browser. Whenever you are connected to a secure server, that connection will be represented in the URL as "https," rather than "http."

(2) Look at your web browser. You have an SSL connection if you see a closed lock or a solid key. If you click on this image, a small pop-up window displaying website security information will appear.

We urge you to protect your own privacy. We recommend that you do not share your Site password(s) with anyone or in any unsolicited phone call or e-mail.

While our Site strives to ensure the integrity and security of our network and systems, Manucurist cannot guarantee that our security measures will prevent third-party hackers from illegally obtaining this information.

5. OPTING OUT

If you would like to stop receiving promotions, updates and/or special offers at any time, you may contact us by clicking here with a statement requesting that you wish to opt out of Manucurist e-mail promotions, updates and special offers. Please allow sufficient time for your request to be processed. It may take up to 10 days to process an email opt-out request, and 4-6 weeks for other requests.

Our Site may include links to websites/applications that are owned or operated by third parties. Please note that this Privacy Policy does not cover the practices of those websites/applications. This includes the right not to be denied goods or services, not to be charged different rates for goods or services, and not to receive a different level or quality of goods or services from us for your exercise of your privacy rights under the CCPA.

As noted above, Right to Know and Right to Deletion are subject to certain limited exceptions: we may not be required to provide you access to the specific pieces of information we have collected about you or delete information if we have not been able to verify your identity, and we may not be required to delete information under certain circumstances. For example, we are not required to delete information that is necessary to complete a transaction, to detect security incidents, or for certain other internal purposes.

Exercising Your Right to Know and Right to Deletion

You may exercise your Right to Know and Right to Deletion by contacting us here. To process your request for access or deletion, we must be able to verify your identity. In order to do so, you must provide the information we request as part of the verification process, such as your contact information and an additional identifier based on your relationship with us. Before we process your request, we will match these data points with data points we currently maintain to verify your identity and your relationship with us.

Sale of Information and Your Right to Opt Out

The CCPA requires us to inform you whether we currently use your personal information (or used your personal information during the past twelve (12) months) in a way that would be considered a "sale" (as defined under the CCPA). We engage (and have engaged for the past twelve (12) months) in activity, including the use of third-party cookies and tags, that could be considered the "sale" (as defined in the CCPA) of (a) online identifiers and (b) internet or other electronic network activity information (each as defined in the table above) to marketing companies that support our online marketing efforts as well as to third parties that may have a secondary use of this information.

Disclosure of Information

The CCPA requires us to inform you whether we disclose your personal information to other parties. We do disclose your information in certain circumstances to Service Providers and other third parties, as described above.

California's "Shine the Light" Law

If you are a California resident and an Manucurist customer, you have the right to request information from us once per calendar year regarding the customer information we share with third parties for the third parties' direct marketing purposes. To request this information, please contact us by clicking here with 'Request for California Privacy Information' in the subject line and in the body of your message. We will provide the requested information to you via an email response.

California's "Eraser Button" Law

If you are a California resident under 18 years old and a registered user of the Site (as defined above), you can request that we remove content or information that you have posted to our website or other online services. Fulfillment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). To request removal of content or information, please contact us by clicking here.

Nevada

If you are a Nevada resident, you have the right to submit a request directing us not to make any sale of your personal information. Manucurist does not sell your personal information. However, to request email confirmation that we do not sell your personal information, please contact us by clicking here with 'Request for Nevada Privacy Information' in the subject line and in the body of your message. We will provide the requested information to you via an email response.

Return Policy

We accept the return of your product(s) up to 30 days after they have been delivered.

The return is possible if your products have never been opened or used, and are in their original packaging! Unfortunately, we cannot accept returns of items if they are used or opened, for sanitary reasons.

The return fees are at the customer's expense, we do not provide prepaid shipping labels.

If your package is returned to the sender due to failure to collect it from the post office or pickup point within 8 days, or because of an incorrect delivery address, missing address information, or due to a refusal of the package by the customer, the recipient being unavailable, you will be refunded the original amount of your order, minus a $10 fee.

This amount covers the administrative costs associated with processing and returning your order.

RefundsUpon receiving the returned Product(s) from you, we will process any refund due to you as soon as possible. You will be refunded in full to your original form of payment, including the cost of standard delivery; however, we will not refund your cost of returning the Product(s) to us. If you received any promotional or other discount when you paid, any refund will only reflect the amount you actually paid.
